These Terms of Use (“Terms”) govern your access to and use of crwdcoffee.com (the “Website”), including purchases, customer accounts, wholesale inquiries, and other services offered through the Website.

The Website is operated by CROWD COFFEE LLC, doing business as CROWD COFFEE (“CROWD COFFEE,” “we,” “us,” or “our”).

By accessing the Website, creating an account, submitting information, or purchasing a product, you agree to these Terms. If you do not agree, please do not use the Website.

1. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to place an order or create an account.

By using the Website, you represent that the information you provide is accurate and that you have the legal capacity to enter into these Terms.

2. Customer Accounts

You may be able to create an account to manage orders, addresses, account information, and other features.

You are responsible for:

providing accurate and current information;
maintaining the confidentiality of your login credentials;
restricting access to your account and devices;
all activity performed through your account.

You must notify us promptly at wholesale@crwdcoffee.com if you believe your account has been accessed without authorization.

We may suspend or terminate an account that contains false information, is used fraudulently, violates these Terms, or creates a security or operational risk.

Creating an account does not guarantee product availability, wholesale approval, special pricing, or continued access to any particular feature.

3. Products and Product Information

We make reasonable efforts to present product descriptions, images, tasting notes, roast profiles, origins, sizes, availability, and prices accurately.

Coffee is an agricultural product, and natural variations may occur between harvests, lots, roast batches, and seasons. Tasting notes describe expected sensory characteristics and do not mean that flavoring ingredients have been added unless explicitly stated.

Product images are provided for general reference. Packaging, labeling, color, and appearance may vary.

We may update, replace, limit, or discontinue products at any time without prior notice.

4. Orders

Submitting an order is an offer to purchase. We reserve the right to accept, reject, limit, or cancel an order for reasons including:

product availability;
incorrect product or pricing information;
suspected fraud or unauthorized activity;
payment problems;
shipping restrictions;
technical or inventory errors.

An automated order confirmation acknowledges that we received your order. It does not necessarily mean that the order has been accepted. Acceptance occurs when payment is approved and the order is processed.

If we cancel an order after payment has been received, we will issue a refund to the original payment method.

5. Prices, Payments, and Taxes

Prices are displayed in U.S. dollars unless otherwise stated.

Prices may change without notice. The price charged will be the price displayed at checkout when the order is submitted, except in the case of an obvious pricing or technical error.

You agree to provide valid and authorized payment information. Payments may be processed by third-party payment providers. Their services may be governed by additional terms and privacy policies.

Applicable sales tax, shipping charges, and other fees will be calculated and displayed during checkout when required.

You are responsible for any taxes, duties, fees, or charges imposed in connection with your purchase unless applicable law requires otherwise.

6. Shipping and Delivery

We currently focus on customers and wholesale partners in New York, but we may accept and ship orders to other locations where service is available.

Available shipping or delivery options, charges, and estimated timeframes will be displayed at checkout or communicated separately for wholesale orders.

Delivery dates are estimates and are not guaranteed. Delays may occur because of carriers, weather, service interruptions, incorrect addresses, high order volume, or other circumstances outside our reasonable control.

Customers are responsible for entering a complete and accurate delivery address. Additional charges resulting from an incorrect or incomplete address may be the customer’s responsibility.

Risk of loss passes to the customer when the order is delivered to the address provided, except where applicable law requires otherwise.

If an order is marked as delivered but cannot be located, please contact the carrier and then notify us so that we can review the situation.

7. Returns, Refunds, and Order Problems

Because roasted coffee is a consumable product, we generally cannot accept returns based solely on personal taste or preference.

If your order arrives damaged, defective, or incorrect, contact us within 7 days of delivery and include:

your name;
order number;
a description of the problem;
photographs of the product and packaging when applicable.

After reviewing the request, we may offer a replacement, store credit, or refund where appropriate.

Approved refunds are issued to the original payment method. Processing times may vary depending on the payment provider.

Shipping charges are generally non-refundable unless the order was incorrect, damaged, or defective because of an error for which we are responsible.

Nothing in this section limits rights that cannot be waived under applicable consumer protection law.

8. Wholesale Accounts and Inquiries

Businesses may submit wholesale inquiries or request samples through the Website.

Submitting an inquiry does not create a wholesale relationship or guarantee approval, pricing, availability, credit terms, samples, delivery service, or exclusivity.

Wholesale terms may be discussed separately based on the needs of the business. Any separate written wholesale agreement or approved account terms will control if they conflict with these general Terms.

Unless otherwise agreed in writing:

there is no minimum wholesale order;
orders are placed through the Website;
prices and conditions may vary based on the arrangement;
samples are subject to approval and availability;
account access and wholesale privileges may be changed or discontinued.

Wholesale customers are responsible for maintaining accurate business, tax, delivery, and contact information.

Products purchased at wholesale may not be repackaged, relabeled, altered, or represented in a misleading manner without our written permission.

9. Promotions and Discount Codes

Promotions and discount codes may be subject to separate conditions, expiration dates, product restrictions, geographic restrictions, and usage limits.

Unless otherwise stated, discounts:

cannot be combined;
have no cash value;
cannot be applied retroactively;
may be changed or discontinued at any time.

We may cancel a discount or promotional order if we reasonably believe the promotion was used fraudulently or contrary to its stated conditions.

10. Acceptable Use

You may not:

use the Website for unlawful, fraudulent, or abusive purposes;
attempt to gain unauthorized access to an account or system;
interfere with the operation or security of the Website;
introduce malicious code, automated attacks, or harmful technology;

Nothing in these Terms grants you ownership of or a license to use our intellectual property except for the limited right to access the Website in accordance with these Terms.

12. Reviews and Submitted Content

If you submit a review, photograph, comment, testimonial, or other content, you represent that:

you created it or have permission to share it;
it is accurate and not misleading;
it does not violate another person’s rights;
it is not unlawful, defamatory, abusive, or deceptive.

You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and adapt submitted content in connection with our Website, products, and marketing, subject to applicable law.

We may remove submitted content at our discretion but are not obligated to monitor all submissions.

13. Third-Party Services and Links

The Website may contain links to or integrations with third-party services, including payment providers, shipping carriers, social media platforms, analytics services, and other websites.

We do not control and are not responsible for the content, availability, security, or privacy practices of third parties. Your use of third-party services is governed by their own terms and policies.

15. Disclaimer of Warranties

Where liability cannot be excluded, our total liability relating to a particular order will not exceed the amount you paid for that order, except where applicable law requires otherwise.

Nothing in these Terms excludes liability that cannot legally be excluded or limited.

17. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless CROWD COFFEE and its owners, employees, contractors, and representatives from claims, losses, liabilities, and expenses arising from:

your violation of these Terms;
your misuse of the Website;
your infringement of another person’s rights;
fraudulent or unlawful activity conducted through your account.

18. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.

Any dispute that cannot be resolved informally will be brought in a court of competent jurisdiction located in New York, unless applicable consumer law requires another forum.

Before filing a claim, you are encouraged to contact us so that we can attempt to resolve the matter.

19. Changes to These Terms

We may update these Terms periodically.

The updated version will be posted on the Website with a revised effective date. Changes apply prospectively from the date they are published unless applicable law requires otherwise.

Your continued use of the Website after updated Terms become effective constitutes acceptance of those Terms.

20. Severability and Waiver

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

Our failure to enforce a provision is not a waiver of our right to enforce it later.
